If a dispute arises between the parties in relation to this Agreement, or out of this Agreement, the parties agree that the following dispute resolution process must be used.

(a) A meeting must be held promptly between the parties, attended by individuals with decision-making authority regarding the dispute, to attempt in good faith to negotiate a resolution of the dispute.

(b) If, within (60) days after such meeting, or such further period agreed to by the parties in writing, the parties have not succeeded in negotiating a resolution of the dispute, the parties agree to submit the dispute to mediation.

(c) The parties must jointly appoint a mutually acceptable mediator. If the parties are unable to agree upon the appointment of a mediator within (15) days after the end of the negotiation period referred to in paragraph (b), the parties must apply with a local competent mediator, or such other organization or person agreed to by the parties in writing, which will, within (15) days of the application, appoint a mediator taking into account.

(i) the need for the mediator to be neutral and independent, impartial
(ii) the qualifications of the mediator,
(iii) the mediator’s fees,
(iv) the mediator’s availability, and
(v) any other consideration likely to result in the selection of an impartial, competent and effective mediator.

(d) The parties agree to participate in good faith in a mediation session which must occur within (30) days after the appointment of the mediator, or such further period agreed to by the parties in writing.

(e) The parties agree that the mediation will be conducted in accordance with the local mediation rules in which place the dispute originated.

(f) If the parties are unable to resolve all issues in dispute in the mediation, the parties agree that the remaining issues in dispute must be determined by arbitration under the arbitration laws in which the dispute originated. The parties agree that the decision of the arbitrator will be final and binding and will not be subject to appeal on a question of fact, law or mixed fact and law.

(g) The parties agree to share equally the costs of the mediation and arbitration, which costs will not include costs incurred by a party for representation by counsel.

SureCondo is a public safety software that is designed to manage the information Security Guards and Private Investigators collect. This information is privately shared between qualified individuals within the Security industry to enhance the personal safety of Guards and Investigators, deters crimes and lowers risk to businesses owners. All members must acknowledge that none of the information that is shared between the security industries will be made public. SureCondo records all information activity and provides mechanism to safeguard against abuse. These mechanisms include email receipts of the search transaction, limited access to the general user and continuous monitoring. Users are governed by privacy laws that prohibit any type of disclosure of private information. The accuracy of any information displayed is not guaranteed. Information at anytime will also be shared with Law Enforcement and anytime.

Personal information collection

SureCondo may collect and use to conduct security activities the following kinds of personal information:

1. name, address, email address, phone number,
2. race, nationality, ethnicity, origin, color, religious or political beliefs or associations,
3. age, sex, sexual orientation, marital status, family status,
4. identifying number, code, symbol,
5. finger prints, blood type, inherited characteristics,
6. health care history including information on physical/mental disability,
7. educational, financial, criminal, employment history,
8. others' opinion about the individual, and
9. personal views except those about other individuals.

Using personal information

SureCondo may use your personal information to:

1. administer access to this system;
2. administer employment activities;
3. identify occupants of a premises and control access;
4. Share information between the security industry of individuals with access to this system;
5. send to you products that you purchase;
6. supply to you services that you purchase;
7. send to you statements and invoices;

Where SureCondo discloses your personal information to its agents or sub-contractors for these purposes, the agent or sub-contractor in question will be obligated to use that personal information in accordance with the terms of this privacy statement.
